PicFish Privacy Policy
General
As a repository of tour information and their associated photographs, Picfish is originated as and has its central purpose as a venue for like-minded people interested in travel to maintain, enjoy, share, and learn about their own and other’s trips and adventures engaged in throughout the world primarily through the medium of photographs. To maximize the utility of this Site to you Picfish provides numerous secondary Services related to travel providing information, enhancing communication, or offering economic benefit, which Services are provided by Picfish alone or working in concert with third parties involved in the travel industry.
Given this communal or sharing ethos, Picfish is nevertheless acutely conscious of and protective of your privacy that you may use the Services comfortably and securely. This document is set out that you know what information you provide us with and that which we collect, how we manage and secure it, and how and under what circumstances it is used or disclosed. In using the Site you are accepting the practices described herein and you expressly agree to our use and disclosure of any information or photographs that you provide.
The Picfish Privacy Policy, last updated 15OCT2005, is revised from time to time, the latest revision at all times appearing on the Site. Should you wish to contact us regarding the Privacy Policy, please do so at email address privacy@picfish.com.
Registrant and Profile Information
The majority of the Services inclusive of looking at tours and photographs do not require that you provide Picfish with any information at all. For the remainder inclusive of authorization to add and maintain your own tours and photographs we require only very minimal information, that necessary to provide you with these Services in a sensible, effective, and efficient way.
Registrant Information consists of your email address and password, the latter held in encrypted form and used to protect your data and photographs from unauthorised access and use. Aside from providing you the basic Services, your email address will not be used by Picfish nor provided to any third party except as specifically authorised by you, which authorisation is determined through a number of questions you answer when registering. You may change your password or authorisation information at any time through My Profile in the upper right corner of the Home screen. You may de-register from Picfish by sending us an email to that effect at email address deregister@picfish.com.
A few of the more minor (but very useful) Services require information beyond the registration information which is input by you in My Profile, principally your name, mail and telephone contact details but additionally your picture should you wish it displayed when your tours are displayed or referenced or at other appropriate times (eg you as a lottery winner). Again, aside from providing these services, your Profile Information will not be used by Picfish nor provided to any third party except as specifically authorised by you, which authorisation is determined through a number of questions you answer when inputting your Profile Information. You may change your Profile Information at any time through My Profile in the upper right corner of the Home screen.
Tour Information and Photographs
A central tenet of the Picfish raison d’etre is that tour information and their photographs be shared and enjoyed by all. Picfish provides you the facilities to log and store your trips and photos, and we would ask that you input your trips data and their photos with a view to sharing them with all picfish users. That said, you have complete control on a picture by picture basis to determine whether a photo and its associated information is ‘public’ or ‘private’, the former allowing viewing on the Site by the Picfish public at large, the latter permitting viewing only by those logged onto Picfish with your email address/password. Please note that if you load your photos through the ‘upload multiple pics’ or the ‘mass pic upload’ options, your pics are loaded as ‘public’. To change pics so loaded to ‘private’ access the tour through Manage Tours in Add Tours and Pictures. Tour information (not photos or photo info) is public in that it is viewable by all Picfish users and is therefore controlled by you insofar as it consists of what you input about your tours (or not).
As a measure towards protecting your photographs from misuse, your full-size photographs (created from the photos you upload to us) are displayed on Picfish with a Picfish logo watermark in the lower left-hand corner of the photo.
Again, except in the provision of its Services (as detailed in the Terms and Conditions), your tour information and photographs will not be used by Picfish nor provided to third parties except as you have specifically authorised in your Registrant and Profile information.
Security
Picfish has security measures in place to assist against the loss, misuse, or alteration of all of the information you provide us. This information may be transferred to and maintained in whole or in part on computer networks which may be outside any governmental jurisdiction in which you reside and may be stored on equipment or in facilities leased or licensed from third parties. No data stored on or transmitted over the internet (or any wireless network) can be guaranteed totally secure. Though we strive to do so within commercially reasonable limits, Picfish cannot and does not ensure or warrant the security of any information you transmit to us and you do so at your own risk. Having received your transmissions, we make our best effort to ensure its security on our systems. As your ‘public’ information and pictures are particularly open to misuse or illegal use, we caution you to carefully consider what you do designate as such. Picfish cannot prevent such information from being used in a manner that violates the law, your personal privacy or your safety. For all information submitted or transmitted to Picfish, you assume the risks and sole liability arising as a result of such information being displayed or otherwise used.
All security provisions aside, Picfish will disclose any held information to legal or governmental authorities if required to the extent required by law or to protect its and Picfish users’ rights, interests, safety, or property.
Cookies
A ‘cookie’ is a small file that we save on your computer’s hard drive that contains non-personal information. These cookies help to give you faster access to pages you have already visited. They also allow you to personalize your pages, and optimise your experience at our Site. We also use cookies to help us figure out how many people visit our site, which of our web pages they visit, and how long they stay there, which information is used to further improve your Picfish experience.
Session IDs
‘Session IDs’ enable us to identify a particular user across multiple web page requests. The Session ID is maintained within your cookie file. A Session ID expires whenever you close your internet browser.
Website Tracking
Utilizing web logs, Picfish collects anonymous data to further understand and analyze how you are using the Site with a view to continual improvement of the Site. Among other data we capture browser used, operating system, search engine keywords, number of visits, paths traversed, time spent on pages. We do not record personally identifiable information. This information is reviewed only internally or by third-parties with whom we have signed Confidentiality Agreements.
IP Address
Each time you visit the Site, we collect your IP Address and the web page from which you came. We use the IP Address to help identify you, collect broad demographic information, and more effectively administer the Site and Services.
Banner Advertisements
Picfish makes and administers all banners and their use in advertising. As such, they are free of cookies. Picfish does not sponsor, endorse or guarantee any products or services advertised by third parties on the Site.
Direct Linking URL’s or Hotlinking
To enhance our Site, Services, or advertising Picfish may utilize referrer logs identifying where and how frequently user images hosted by Picfish are being displayed on third party sites.
Third-Party Websites
Picfish places links to third-party websites on the Site and includes such links from time to time in its non-Site communications. Some of these websites contain our brand names and trademarks and other Picfish-owned intellectual property, some do not. Irrespective of what is contained on any third party website, your access to a third-party website through a link on our Site or otherwise provided is entirely at your own risk and your sole responsibility, the Privacy Policy provisions herein not applying. We recommend that you review the Privacy Policy of any third-party site that you access, understanding that its provisions are without qualification independent of Picfish and the Picfish Privacy Policy, and agreeing that Picfish is in no way responsible or liable for any circumstance stemming from your access or use of a third-party website.
